Terms of Service

The rules for using SitePlanMaker, including account, plan accuracy, payment, export, and liability terms.

1. Agreement and company

These Terms govern your use of SitePlanMaker, a service provided by MTTenterprise Inc. By creating an account, using the service, or purchasing a plan or subscription, you agree to these Terms and the linked policies. If you use SitePlanMaker for an organization, you confirm that you can bind that organization.

2. What SitePlanMaker provides

SitePlanMaker is self-service drafting and workflow software. It helps users organize property information, trace or draw geometry, calculate dimensions, research publicly available permit requirements, run completeness checks, and create site-plan exports from user-provided information.

SitePlanMaker is not a land surveyor, architect, engineer, lawyer, building official, or permit authority. It does not perform a site visit, locate legal boundary monuments, certify a survey, provide legal or engineering advice, or guarantee that any authority will issue a permit.

3. Accounts and eligibility

  • Provide accurate account information and keep it current.
  • Protect your password, passkeys, recovery codes, and shared review links.
  • You are responsible for activity under your account and for promptly reporting suspected misuse.
  • You must be at least the age of majority needed to enter this agreement in your jurisdiction.

4. Your content and permissions

You keep ownership of documents, measurements, drawings, and other content you submit. You grant MTTenterprise Inc. a limited, non-exclusive licence to host, copy, convert, analyze, display, and transmit that content only as needed to operate, secure, support, and improve the service as described in the Privacy Policy.

You confirm that you have the right to upload and process the content, that it is accurate to the best of your knowledge, and that sharing it through SitePlanMaker does not violate another person’s rights or applicable law.

5. Your plan responsibilities

  • Verify the property address, legal description, lot boundaries, dimensions, orientation, structures, easements, setbacks, utilities, and proposed work against reliable sources.
  • Confirm current zoning, permit, and submission requirements directly with the applicable authority before relying on an export.
  • Use a licensed surveyor or other qualified professional whenever required or when legal boundary or certification accuracy matters.
  • Review every AI suggestion, extracted value, readiness result, and exported sheet before use or submission.
  • Maintain your own source documents and backups.

6. Free and paid exports

A free account may build and review a project and download a watermarked PNG preview when the drawing fits the selected sheet. Print, PDF, SVG, DXF, and GeoJSON downloads require a paid project credit. Paid output may still contain a concept, proposal, professional-review, or not-for-submission notice when the selected output level or readiness status requires one.

A project credit unlocks export formats for one project. The service may require completion of readiness checks before a credit can be applied or a paid export can be generated.

7. Fees, subscriptions, and taxes

Prices, included credits, and features are shown at checkout. Subscription fees are billed in advance and renew automatically until cancelled. You may cancel future renewals through available account controls or by contacting support. You remain responsible for applicable taxes and charges imposed by your payment provider.

Stripe processes payments. We may suspend paid features for failed, reversed, fraudulent, or disputed payments. Refund eligibility is governed by the Refund Policy and mandatory consumer law.

8. AI-assisted features

Automated extraction, drafting suggestions, municipality research, and readiness checks can be incomplete or wrong. A confidence score, citation, or automatic review status is not a professional certification or government approval. The AI Disclosure forms part of these Terms.

9. Acceptable use

  • Do not use the service for unlawful, deceptive, infringing, abusive, or unsafe activity.
  • Do not upload malware, probe or bypass security, evade usage limits, scrape the service, or interfere with other users.
  • Do not resell account access, falsely present an output as certified, remove required notices, or use the service to impersonate a licensed professional or public authority.
  • Do not submit personal or confidential information that is not reasonably needed for the project.

10. SitePlanMaker intellectual property

MTTenterprise Inc. and its licensors own the service, software, interface, templates, trademarks, and documentation. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the service and use your generated exports for your projects, clients, and permit applications.

11. Availability and third parties

The service may change, experience downtime, or depend on third-party hosting, payments, AI, mapping, email, and government websites. We may suspend access for maintenance, security, legal compliance, misuse, or non-payment. Third-party sites and data remain governed by their own terms.

12. Disclaimers

To the maximum extent permitted by law, the service and outputs are provided as available and without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, permit acceptance, uninterrupted availability, or professional compliance. Consumer rights that cannot legally be excluded remain in force.

13. Limitation of liability

To the maximum extent permitted by law, MTTenterprise Inc. will not be liable for indirect, incidental, special, punitive, or consequential loss, including delay, lost profit, permit costs, construction costs, property damage caused by inaccurate inputs, or loss of data. Our total liability arising from the service will not exceed the greater of CAD $100 or the amount you paid to SitePlanMaker during the 12 months before the event giving rise to the claim.

14. Suspension, termination, and governing law

You may stop using the service and delete your account. We may suspend or terminate access for a material breach, unlawful activity, security risk, or non-payment. Terms that by their nature should survive will continue after termination.

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to mandatory consumer rights, disputes will be brought in the courts located in Ottawa, Ontario.

15. Changes and contact

We may update these Terms. We will provide reasonable notice of material changes when required. Continued use after the effective date means you accept the updated Terms.
